Establishing the actual use of roads – a record that is not an end in itself
The Act Regulating the Records of the Existing Land Use of the Public Road and Railway Infrastructure (ZEDRZ) already came into force in 2018. Despite this, some municipalities still have not recorded the actual use of municipal roads. Moreover, there are also many municipalities that established the records for actual use only in order to satisfy the requirements of the legislation. Now that the adoption of the property tax is being talked about again, the Slovenian Infrastructure Agency has once again started reminding municipalities to set up their records. At the same time, I advise all municipalities to check the correctness of their current actual use records, especially if any changes were made to the categorization of municipal roads after submission; in this case, some of the information on actual use might not be up-to-date.
Records of actual use are not an end in itself. In addition to determining which plots are covered by categorized roads, this information can be used in the valuation of real-estate and for the purposes of the property tax. Moreover, with the help of these records, quality data for the purposes of purchasing land with municipal roads can also be obtained. The actual use of roads is also excellent data for monitoring the condition of the area, planning the development of the area and determining building land use. However, in order to optimally use the records for any purpose, it is necessary to put some effort into the arrangement and not just comply with the legislation.
